You are currently visiting askfornudes.com or app.askfornudes.com which are operated by NINETAILS MEDIA LTD, a company duly registered under the laws of Cyprus, with principal office at Agias Faneromenis, 143-145, Patsias Court, Flat/Office 201, 6031, Larnaca, Cyprus ("AskForNudes", "Company", "We", "Us", "Our"). The interactions between Users and AskForNudes should be governed by these Terms of Service. Models' Terms of Use are additional terms which apply only if You use AskForNudes as the Model.

Before using the Website, please carefully read this Agreement. If there is anything in this Agreement that You disagree with, please stop using the Website.

To understand how We process Personal Data, please refer to Our Privacy Policy. The Privacy Policy is an integral part of this Agreement and must be read in conjunction with them and before accessing Company's Services. Collectively, with Models' Terms of Use constitute the "Agreement".

These Terms of Service are concluded in accordance with the laws of Cyprus.

• 1. DEFINITIONS
  • 1.1. Content — any material uploaded by the Model or Fan in the chat between Fan and Model, including any photos, data, text (such as comments and hashtags), metadata, images, emojis, GIFs, memes, and any other material whatsoever.
  • 1.2. Consumption Tax — value added tax and any other tax imposed in addition to or in substitution for it at the rate from time to time imposed, as well as any equivalent or similar governmental, state, federal, provincial, or municipal indirect tax, charge, duty, impost, or levy in any other jurisdiction.
  • 1.3. Model(s) — Users who have set up their account on the Website as a Model account in order to post Content for other Users to view.
  • 1.4. Model account — an account created after registering on the Website which contains information about the Model.
  • 1.5. Model(s) content — any material uploaded by the Model in the chat between Fan and Model to the Website, including any photos, data, text (such as comments and hashtags), metadata, images, emojis, GIFs, memes, and any other material whatsoever.
  • 1.6. Fan(s) — Users who have set up their account on the Website as a Fan account in order to chat with the Models and view their Content.
  • 1.7. Fan Payment — any and all payments made by the Fan to the Website in conjunction with the Paywall removal services.
  • 1.8. Paywall — means a lock mechanism, which is requested by the Model and set by the Website on the Model's Content.
  • 1.9. Personal account — an account created after registering on the Website which contains information about the User.
  • 1.10. Personal Data - means any information by which an individual can be identified, or information that can directly or indirectly identify or relate to any individual.
  • 1.11. User(s) — means visitors to the Website, Models, Fans or other people using the Website. Could be addressed as "You", "Your".
  • 1.12. Registration Form — page on the Company's Website where the User must enter all relevant registration information to access the Website in accordance with this Agreement.
  • 1.13. Service(s) — means a set of services, offered by AskForNudes, which consists of hosting the relevant Model's Content and getting a place for communication between Models and Fans.
  • 1.14. Tax — all types of tax and statutory, governmental, state, federal, provincial, local, or municipal charges, duties, imposts, contributions, levies, withholdings, or liabilities wherever chargeable.
  • 1.15. Website — the website, owned and operated by the Company, askfornudes.com or app.askfornudes.com.
• 2. THE SUBJECT MATTER
  • 2.1. By using the Services, You acknowledge that You have read and comprehend this Agreement and that You agree to them. Services that We provide on Our Website include, but are not limited to: a) hosting the Models Content; b) facilitating communication between the Models and the Fans via chat; с) acting as an intermediary platform, without creating or providing any Сontent.
  • 2.2. This Agreement shall not be deemed illegal, void, or unenforceable in its entirety if any provision of it is found to be so by applicable law, or if such determination is made by an appropriate court ruling.
  • 2.3. You acknowledge that the Company is not the Model or the Fan, and the Company does not provide any services other than the hosting of the relevant Models' Content and a place for communication between Models and Fans. We are not publishers of any content on the Website.
  • 2.4. The Company offers the Services in compliance with the laws and regulations that apply to the Company's provision of Services to its Users generally, subject to the User's use of the Services in accordance with this Agreement, regardless of the particulars of the User's usage of the Services.
  • 2.5. The Company has no control over the User's behavior and how the User uses the Services or any other part of the Services that the User provides or receives.
  • 2.6. The Company does not endorse, verify, or assume responsibility for any Content uploaded by Models. The Company acts only as a hosting provider and intermediary within the meaning of Article 3(g) of the European Digital Services Act and any analogues in your jurisdiction and shall not be liable for any claims arising from the nature, legality, or use of such Content.
• 3. REGISTRATION ON THE WEBSITE
  • 3.1. To access the Service, the Users must accept the Agreement and the Privacy Policy when filling out the Registration Form on the Website and creating a Personal account.
  • 3.2. The User must provide truthful, complete, and reliable information and keep it up to date.
  • 3.3. The Users agree that they are solely responsible for providing the correct information in the Registration Form that they use to access the Website.
  • 3.4. For Models. The procedure and conditions for registration of the Models are described in detail in the Section 2 the Models' Terms of Use. After registration and account verification, Model will be able to upload the Content, start communication with the Fans only through the Platform, will be able to provide his/her Content to the Fan and set the appropriate price for it. You also need to agree with Terms of Services, Privacy Policy.
  • 3.5. For Fans. The Fan fills in the Registration's Form on the Website by entering the relevant registration information, which may include, but is not limited to, nickname, password, email address. You also need to agree with Terms of Services, Privacy Policy and confirm the age of majority.
    • 3.5.1. Your password should be unique (i.e., different from those You use on other websites) and must meet the technical requirements of AskForNudes for password formulation.
    • 3.5.2. After filling all the information, the Fan's account will be opened. After that, a letter will be sent to the Fan's e-mail address with the verification link.
    • 3.5.3. To verify the opened Fan account, the Fan needs to open the letter and click on the word “link”. After that, the Fan will be able to use the Fan account.
  • 3.6. For all Users. You need to quickly update any of the information You have provided to Us as it changes. For this purpose, the Website provides an opportunity to make changes to the Personal account in the account settings.
    • 3.6.1. AskForNudes cannot guarantee any User that verification will be granted to their account, and We are not obliged to inform the User regarding the reasons for the rejection.
    • 3.6.2. If the User fails to comply with the verification request by providing false or misleading information about the identity or attempts to circumvent Our verification system, We reserve the right to permanently block the User’s account and the access to the Website.
  • 3.7. You agree to receive communications from Us electronically, via email, and to the processing of Your Personal Data as further specified in Our Privacy Policy.
  • 3.8. If the Users become aware of any unauthorized use of their Personal Data, they must immediately notify the Company by contacting the support service at support@askfornudes.com.
  • 3.9. During registration on the Website, Users will not disclose (or, in case of disclosure, bear sole and full responsibility for) name, surname, e-mail addresses and other Personal Data or data of third parties without their personal consent to such actions explicitly provided by filling out a Registration Form.
    • 3.9.1. After the Fans fill out the Registration Form, they will access the list of Models. Then, the Fan will be able to start communication only through the Platform with the Model and subsequently access the relevant Model's Content for the appropriate payment.
  • 3.10. Users can delete their Personal account at any time by sending an email to support@askfornudes.com or directly through the User's Account settings page by clicking the button "Delete account". However, You acknowledge that deleting Your account will not prevent the circulation of Your Content which may have been recorded by other Users in any way that breaches Our Terms of Service, Models' Terms of Use or by any third party prior to the deletion of Your account.
  • 3.11. The Models cannot delete their personal Models' account if:
    • 3.11.1. any amount of funds is available on their Pending balance;
    • 3.11.2. any amount of funds is available for withdrawal or there is any active withdrawal request still unprocessed by Us;
    • 3.11.3. the Model's account is under investigation process started by AskForNudes because of the violation of the Website's Terms of Service and/or Models' Terms of Use;
    • 3.11.4. there are any unprocessed refunds' requests that are related to their Model's account;
    • 3.11.5. there is any other legitimate reason that prevents the ordinary process of deleting their Model's account.
• 4. RULES OF USAGE
  • 4.1. To gain access to the Website, Users must be at least 18 (eighteen) years old, and will be required to confirm it in the following ways:
    • 4.1.1. on the askfornudes.com by pressing a button "I am 18 or older - Enter" in the modal window with the requirement of age confirmation of the User. If You are under the age of 18 years, You must press the button "I am under 18 - Exit" and leave the Website.
    • 4.1.2. on the app.askfornudes.com by checkbox confirmation of the age of the User during the registration together with confirmation of Terms of Service and Privacy Policy.
    • We may request additional certifications, such as uploading government-issued documents, at our sole discretion, depending on your country of residence.
  • 4.2. If the laws of the country where You live state that You can only be legally bound by a contract with Us if You are over the age of 18, You must be of legal age to be legally bound by a contract with Us under the laws of that country.
  • 4.3. You must be permitted by the laws of the country in which You are located to join the Website, access any Content available on it, and use any of its functionality.
  • 4.4. Fans located in other jurisdictions, except for the countries-members of the European Economic Area, are strictly prohibited from making any payments on the Website.
  • 4.5. You must give any further information or verification records that We require.
  • 4.6. If You do not match the conditions listed in this Section 4, You must not access or use this Website.
  • 4.7. You acknowledge that You are aware that some Content on AskForNudes contains adult material, and You agree to take this into account when deciding where to access and view the Content.
  • 4.8. Please use AskForNudes only for personal purposes, and do not sell, rent, transfer, or distribute Your Personal account or any Content obtained through Your use of AskForNudes to anyone else.
  • 4.9. The Website can only be used in the circumstances specified in the Agreement.
  • 4.10. Do not use AskForNudes in any way that may exploit, hurt, or seek to exploit or harm anybody, such as by exposing them to the inappropriate Content.
• 5. PROHIBITED CONTENT
  • 5.1. USERS SHALL NOT UPLOAD, POST, OR PUBLISH ANY CONTENT ON ASKFORNUDES THAT SHOWS, INCLUDES OR REFERS TO, PROMOTES, ADVERTISES: animals, firearms, weapons, or any goods whose sale, possession, or use is subject to prohibitions or restrictions; drugs, drug paraphernalia or alcohol; self-harm or suicide; blackmail; Content creation with artificial intelligence; blood; bleeding asphyxia; incest; zoophilia; choking; bestiality; bestiality; violence; brutality; rape; lack of consent; hypnosis; intoxication; sexual assault, torture; sadomasochistic abuse or hardcore bondage; extreme fisting; groping; incapacitation; or genital mutilation; necrophilia; urine; enema; feces; fetus; chloroform; the Content that contains extreme conditions or circumstances; scenes of slavery; scenes with children and/or infants; scenes with the use of force; disgrace scenes; the Content that harms human dignity; scatological, or excrement-related material; “revenge porn” (being any sexually explicit material featuring any individual who has not given prior, express and fully informed consent to that material being taken, captured, or otherwise memorialized, or being posted and shared on AskForNudes); escort services; sex trafficking, or prostitution; contains unsolicited sexual Content or unsolicited language that sexually objectifies another User or anyone else in a non-consensual way, or contains fake or manipulated sexual Content in relation to another User or anyone else (including “deepfakes”); contains, promotes, advertises or refers to hate speech (being Content intended to vilify, humiliate, dehumanize, exclude, attack, threaten, or incite hatred, fear of, or violence against, a group or individual based on race, ethnicity, national origin, immigration status, caste, religion, sex, gender identity or expression, sexual orientation, age, disability, serious disease, veteran status, or any other protected characteristic); contains or refers to anyone else's Personal Data or private or confidential information (for example, telephone numbers, location information (including street addresses and GPS coordinates), names, identity documents, email addresses, log-in credentials for AskForNudes including passwords and other information) without that person's express written consent.
  • 5.2. The Model is prohibited to UPLOAD, POST, OR PUBLISH any kind or forms of pornographic Content intended to arouse unhealthy or unnatural sexual needs of other persons and thereby distort moral ideas and inclinations in the field of sexual relations, gross naturalism and sexual vulgarity. All the Content on the Website shall be considered as erotic, artistic works that reflect the beauty of the human body and the manifestation of natural intimate feelings.
  • 5.3. Anti-Slavery and Human Trafficking. AskForNudes is against all forms of contemporary slavery, human trafficking, sex trafficking, and abuse. Modern slavery is a crime that violates fundamental human rights. It can take many forms, including slavery, servitude, forced and compelled labor, and human trafficking, all of which involve depriving someone of their liberty in order to exploit them for personal or commercial benefit. We are dedicated to behaving with integrity and lowering the risk of modern slavery and human trafficking in our commercial dealings and connections with producers and Users. We are also committed to treating all employees, partners, and vendors with dignity and respect, providing safe working conditions, and operating in an environmentally responsible and ethical manner.
  • 5.4. PLEASE DO NOT UPLOAD, POST, SHOW, OR PUBLISH ANY CONTENT ON ASKFORNUDES WHICH: a) features public nudity, was recorded in or is being broadcast from a country where public nudity is illegal; b) features sexual activities, was recorded in or is being broadcast from a public place where members of the public are reasonably likely to see the activities being performed (this does not include outdoor places where members of the public are not present, for example private property such as a private backyard, or secluded areas in nature where members of the public are not present); c) gives the impression that it comes from or is approved, licensed or endorsed by Us or any other person or company; d) is used or is intended to be used to extract money or another benefit from anyone else in exchange for removal of the Content; and/or involves or promotes third-party commercial activities or sales, such as contests, sweepstakes, and other sales promotions, product placements, advertising, or job posting or employment ads without Our prior express consent.
  • 5.5. Do not use AskForNudes to stalk, bully, abuse, harass, threaten, or intimidate anyone; or to participate in misleading or deceptive behavior that is likely to mislead or deceive another User.
  • 5.6. Do not impersonate Us, one of Our employees, another User, or any other person or company, or falsely declare or imply any relationship, endorsement, or sponsorship between You and Us or any other person or company.
  • 5.7. Fans are prohibited from downloading, distributing, modifying, selling, or using the Content for any purposes other than those provided in this Agreement.
  • 5.8. Except as expressly permitted by the Agreement, You may not reproduce, print, distribute, attempt to download, alter, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content.
  • 5.9. The Users acknowledge that they will use the Website in line with this Agreement, take full responsibility for any actions taken on the Website, and will not use any of the Services in any way that:
    • is false, misleading; constitutes or encourages criminal activity;
    • violates applicable laws, rules, and/or regulations; may infringe upon third parties' property rights, including, but not limited to, information or materials that infringe upon their right to privacy and confidentiality;
    • may infringe upon third parties' property rights, including, but not restricted to, data or materials that infringe upon their rights to privacy and confidentiality, trade secrets, industrial designs, patents, copyrights, and other legally protected information;
    • may interfere with the provision of Services, such as sending feedback to the Company or posting any marketing materials—such as spam, phony emails, unsolicited mail, and other similar forms of solicitation—on the Website without the Company's prior written consent;
    • use the Website only for the reasons for which it was intended. Any further unauthorized or illegal use of the Website is considered a violation of the Agreement, for which the offending User will be responsible under the laws that apply.
  • 5.10. Users warrant that they have all legal authority to create a binding legal obligation. The User should be at least 18 (eighteen) years of age to use Our Services.
  • 5.11. In particular, the User agrees to refrain from the following: fraudulent acts; alterations to any Website pages; unauthorized access to the Website or its code; breaches of the Company's or any third party's rights to privacy, other intellectual property rights (such as, but not limited to, copyrights, trademarks, and broadcasting rights), or other rights; no portion of Our Services may be reproduced, altered, transformed into a derivative work, downloaded, modified, reverse engineered, emulated, transferred to another service, translated, compiled, decompiled, or disassembled; checking, scanning, or probing for vulnerabilities in Our Services or any network they are connected to; taking any action that would put an unreasonable or disproportionate amount of strain on the systems or networks linked to the Services, the servers hosting the Services, or any other network that is involved in their provision, or that would interfere with or disrupt any of these servers or networks, or that would breach any guidelines, policies, procedures, or other rules governing them; creation of works derived from any sources of data or materials; impersonation of another person; making copies of the Website, using its code, or engaging in other activities involving the code or other Services the Website lists; restriction or prevention of any other User from using the Website; using bots; avoiding the security measures; overloading the Website; engaging in cyberattacks; interfering in any other manner with the Website's regular operation; utilizing programs that could be used to steal, covertly intercept, harm, or otherwise tamper with any system, data, or Personal Data.
  • 5.12. The list of forbidden uses and these guidelines for behavior are not designed to be all-inclusive. We reserve the right to decide what behavior We deem to be improper or a breach of this Agreement, as well as the suitable course of action.
  • 5.13. You, as the User, acknowledge that it is Your responsibility to abide by any local laws that could be relevant to Your use of Our Services.
  • 5.14. We can, but are not bound, to moderate or review any of Your Content to ensure compliance with the Terms of Service and/or any relevant laws.
  • 5.15. Additional restrictions applicable to specific User categories, such as the Models, are detailed in the respective Terms of Use.
• 6. INTELLECTUAL PROPERTY AND PROPRIETARY RIGHTS
  • 6.1. Company's proprietary rights. The Website and all of its components and codes are the exclusive property of the Company.
  • 6.2. The Company owns all rights, titles, and interests in the Services and all related intellectual property rights, except for the restricted rights expressly stated in this Agreement. The User is only entitled to the rights specifically granted by this Agreement.
  • 6.3. The User acknowledges, understands, and consents that the Company is the sole owner of all intellectual property rights on the AskForNudes and Our Services. It is prohibited by the Agreement to utilize any trademarks without permission.
  • 6.4. It is forbidden to copy any works, including but not limited to articles, content, as well as the Website's code and design. It is also prohibited to use the Website or its material inappropriately or without authorization in accordance with the Agreement. Only links to the Company's Website or the website of a third party with authorization to use the Company's materials may be included with articles that are posted on the Website or other third-party websites.
  • 6.5. Licenses. By using the Company's Services, the User grants the Company a perpetual, irrevocable, royalty-free license to use and incorporate any comments, feedback, requests for changes, suggestions, or other information provided by Users regarding the way the Company operates or about the Services itself.
  • 6.6. Users may instantly lose access to the Website and be held legally responsible in line with the applicable laws if they violate the Agreement. Regarding the Content posted on the Website, the Company is the exclusive owner of all rights.
  • 6.7. For additional provisions specific to Models, refer to the Models' Terms of Use
• 7. LINKS TO OTHER WEBSITES
  • 7.1. The Company may place links to other subjects' ("third-party links") websites on the Website, create links to the Company's pages on other social media platforms, for example, or use other services to upload material. If any of the third-party links violates the Agreement, We shall immediately remove them from the Website.
  • 7.2. We cooperate with third-party service providers, including but not limited to the Contractors, who provide Us with services such as website development, hosting of Website, maintenance, emailing, marketing, technical support and collateral, information technology and cybersecurity services, customer support, and other services. These contractors may access the Personal Data or process it on Our behalf as part of their services to Us.
  • 7.3. The Website may contain links to third-party websites which are connected to Us in any way. We shall not be responsible for any content, inner and outer policies, opinions or practices of and make no representation or warranty regarding the accuracy, completeness or authenticity of information contained in any third party websites. We have no control over or right to modify the content of any third party websites. You acknowledge that We shall not be liable for any and all liability arising from Your use of any third-party websites.
• 8. PAYMENT PROCEDURE
  • 8.1. This section describes the Agreement's clauses which apply to the Transactions on the Website.
  • 8.2. All Fans' Transactions are contracts between Fans and the Website that follow the conditions of the Agreement. Although We enable Fan Transactions by offering the AskForNudes Services and allowing the Models to upload the Content on the Website, We are not a party to the Fan and Model contract or any other contract that may exist between the Fan and Model, and We are not liable for any Fan Transaction.
  • 8.3. The Fans need to find preferable Model and the Content they want to access, click on the button "UNLOCK", and then they are going to be redirected to the payment page, where the Fans need to enter the following information: full name of the card owner, bank card number, name of the bank, CVV code, expiration date. After making a successful payment, the Fans are automatically taken to the AskForNudes page. Once the values are received, the Fans will be able to access and view the Model's Content.
  • 8.4. In order to unlock the Content, the Fan needs to fill in all the fields on the "Billing info" page.
  • 8.5. Fan payments do not include the Consumption Tax, unless otherwise required by the law.
  • 8.6. You permit Us to transfer Your payment card information to a third-party payment provider for the purpose of processing Your Fan Payment. All Fan payments will be charged in USD. Your payment card issuer may charge You currency conversion costs. We have no control over the currency conversion rates or charges imposed by Your payment card issuer or bank, and We will not be liable for any such charges or fees.
  • 8.7. We can change the third-party payment providers used to process payments on AskForNudes and if We do so, We will store applicable details on Your account.
  • 8.8. Your bank may charge You currency conversion or transfer fees when You get the money. Additionally, Your e-wallet provider may charge You a fee to access the funds. We have no control over currency conversion rates or charges imposed by Your bank or e-wallet business, We will not be liable to pay any such charges.
  • 8.9. We retain the right to close Your Personal account if We are alerted or become aware of any tax noncompliance by You.
  • 8.10. We may terminate Your account if You have repeatedly violated the Agreement, or if You threaten to violate them in a way that could have serious consequences for Us or another User, including potential loss.
• 9. REFUNDS AND CHARGEBACKS
  • 9.1. Refunds.Please read carefully Our Refund Policy regarding the refunds' option.
  • 9.2. Chargebacks. By making a payment on the Website, You agree that all transactions are final. Any chargeback request made through Your payment card issuer or bank must have valid grounds. Unjustified or fraudulent chargeback requests are strictly prohibited. If We determine that a chargeback was initiated in bad faith, We reserve the right to:
    • 9.2.1. Suspend or permanently terminate Your account.
    • 9.2.2. Take legal action to recover any losses incurred due to the chargeback, including the disputed amount and associated fees.
  • 9.3. Before initiating a chargeback with Your bank or card issuer, You are encouraged to first contact our support team at support@askfornudes.com to resolve any disputes regarding content.
  • 9.4. If a chargeback is found to be unjustified, You may be responsible for covering any administrative fees incurred by Us as a result. These fees may be deducted from future payments or charged directly to Your payment method.
• 10. WARRANTIES AND WAIVER
  • 10.1. Fans warrant that:
    • 10.1.1. they are at least 18 years old (or the legal age of majority in their jurisdiction) and that they are legally permitted to access adult content in their region;
    • 10.1.2. they have read the Terms of Service, Privacy Policy and Cookie Policy on the Website very carefully;
    • 10.1.3. the information provided during the registration process (such as their name, email address, and payment information) is accurate, complete, and up-to-date;
    • 10.1.4. they will comply with all applicable laws when accessing content on the platform and will not use the services for any unlawful purposes;
    • 10.1.5. hey will only use the platform for personal purposes and not for any commercial exploitation of the content, such as redistributing or reselling any material.
  • 10.2. Fans waive any right:
    • 10.2.1. to ownership of any Model's content they have paid for;
    • 10.2.2. to hold the Company, being an intermediary platform, liable for any Content on the Website, which is owned by Models;
    • 10.2.3. to claim for any misrepresentation in the Model's Content they have paid for;
    • 10.2.4. to chargebacks before initiating a refund with the Company
    • 10.2.5. for any claim arising out of any of Your expectations of merchantability, fitness for a particular purpose, non-infringement, quality, accuracy, integration or quiet enjoyment of the Model's Content.
• 11. DISCLAIMERS AND LIMITATION OF LIABILITY
  • 11.1. The Company aims to provide a convenient Website experience. However, the Company disclaims all liability for any improper use of the Website by Users. The material on the Website is presented on an “AS IS” basis and without any warranty or condition, express, implied or statutory, and there may be technical or typographical errors. Users are advised not to base any business decisions on the information published on the Website, as the Company makes no representations or warranties regarding the accuracy of the published data.
  • 11.2. It is Your personal duty and risk to use this Website. The User's actions on the Website are beyond the Company's control and responsibility.
  • 11.3. The Website's operation in any particular area is not guaranteed by the Company to be acceptable, accurate, or accessible for use. Any information published on the Website is only correct at the time of publication and may not be correct when the Website is used later. It's possible that the Website is limited to certain nations or languages.
  • 11.4. THE SERVICES MIGHT NOT BE UNINTERRUPTED OR SECURE. USERS UNDERSTANDS THAT THERE ARE ALWAYS RISKS TO THEIR CONFIDENTIALITY, PRIVACY, AND SECURITY. Consequently, the Users agree to waive all claims for circumstances beyond of the Company's control.
  • 11.5. It is entirely the responsibility of Users to ensure that information they contribute is accurate, relevant, and private.
  • 11.6. Only Users who have reached the age of majority in accordance with the laws of their country (usually 18 years or another appropriate age of majority provided by the laws of Your country) could use the Website and receive the Services.
  • 11.7 We do not authorize or approve the Content on the Website, and the opinions expressed by Models and Fans on AskForNudes do not necessarily reflect Our own.
  • 11.8. We do not grant Fans any rights in connection to the Content. Such rights can only be provided to You by Models.
  • 11.9. If jurisdictions do not allow the disclaimer of implied warranties, therefore in such jurisdictions, some of the foregoing disclaimers may not apply to You insofar as they relate to such implied warranties.
  • 11.10. While we endeavor to keep AskForNudes secure and free of bugs and viruses, we cannot guarantee it and have no control over the Content given by Models. All Content is produced, selected, and given by Users, not Us. We do not pick or edit the Content saved or sent by AskForNudes.
  • 11.11. You accept that You are under no duty to follow any suggestions, comments, reviews, or directions received from another AskForNudes User, and that doing so is totally at Your own risk.
  • 11.12. We make no assurances or guarantees that the Models will profit from their use of AskForNudes.
  • 11.13. The materials available on AskForNudes for Users are intended to provide general information only. We make no claims or assurances concerning the correctness of such resources, or that Users will obtain any specific result or consequence of utilizing them.
  • 11.14. We do not guarantee that AskForNudes is compatible with all devices or operating systems. You are responsible for configuring Your information technology, device, and computer applications so that You may access AskForNudes. You should use Your own antivirus program.
  • 11.15. We are not liable for the availability of the Internet or any failures in Your connections, device or other equipment, or software that may occur as a result of Your use of AskForNudes.
  • 11.16. While We strive to ensure that AskForNudes is secure and free of bugs and viruses, We cannot guarantee this and have no control over the Content provided by Models.
  • 11.17. We are not liable for any lost, stolen, or hacked Users accounts, passwords, email, or any subsequent unauthorized activity, payments.
  • 11.18. Under no circumstances, We will not be responsible to You if You suffer any loss or direct, indirect incidental, special, consequential or exemplary damages (even if We have been advised of the possibility of such damages) as a result of Your using the Website, accessing or viewing the Content containing adult material in a way which places You in breach of any contract You have with a third party (for example, Your employment contract) or in breach of any applicable law, whether, such damages arise from, but not limited to (i) Your use, misuse, misconduct or inability to use the Website, (ii) Your own reliance on any Content or third-party content on the Website, (iii) the interruption, suspension, modification or complete discontinuance of the Website or (iv) the termination of this Agreement by Us. These limitations also apply to damages arising by any other services or products received or advertised in connection with the Website. Some jurisdictions do not allow some limitations of liability mentioned in this Section 11, therefore, in such jurisdictions, some of the foregoing limitations may not apply to You.
  • 11.19. We are not liable for any lost, stolen, or hacked the User accounts, passwords, or email accounts, or any subsequent unauthorized activity, payments, or withdrawals of monies.
  • 11.20. The Company will provide Services to the User on an ongoing basis. The Company's actions to implement this Agreement, which are not carried out automatically, will be carried out on weekdays.
  • 11.21. THE COMPANY MAKES NO WARRANTIES REGARDING:
    • THE SERVICES, RELATED SOFTWARE, RELATED HARDWARE, AND YOUR COMPUTER WILL ALL BE COMPATIBLE;
    • THE SERVICES' AVAILABILITY, UNINTERRUPTED OPERATION, ERROR-FREE, OR CORRECTION OF ANY ERRORS;
    • ON OR THROUGH THE SERVICES, ACCURATE, COMPLETE, SEQUENTIAL, OR TIMELY INFORMATION WILL BE AVAILABLE;
    • THE COMPANY WILL STORE ANY USER'S INFORMATION SENT TO IT.
  • 11.22. By using the Website, the User agrees to take all necessary security precautions and not rely on the Company.
  • 11.23. The User understands that any Website could experience hacking, virus assaults, data manipulation, and other uncontrollable events.
  • 11.24. Through the use of the Website, the User unconditionally releases the Company from all liability and commits to refraining from suing the Company. By using the Website, the Users agree not to bring any claims for losses they may have suffered.
  • 11.25. The Company acts as an intermediary service within the meaning of Article 3(g) of the Digital Services Act by providing caching and hosting services. In accordance with Articles 13 and 14 of the Digital Services Act, the Company shall not be liable for the automatic, intermediate, or temporary storage of information performed solely to enhance the efficiency of information transmission. Furthermore, the Company disclaims liability for any information stored on the Website, provided such storage complies with the conditions established by the Digital Services Act. Users are advised to ensure their use of the Website aligns with applicable laws and regulations and acknowledge that the Company has no control over the content stored or transmitted by Users.
• 12. NON-CIRCUMVENTION
  • 12.1. You agree not to circumvent the Company and its Website in any way possible. All transaction and exchange of information, Content, messages between the Fans and the Models shall be undertaken within the Website and its chat. You expressly agree and warrant that You will not try to circumvent or induce the other party to do so. In case of any breach, You agree to compensate Us the fee for Paywall removal and costs of Monetisation earnings of such Model for the previous 2 months.
  • 12.2. We are not responsible for any transactions and information exchanges conducted in breach of this Section.
  • 12.3. Fans found to be engaging in circumvention activities, including direct transactions with Models outside the Website, will be subject to immediate account termination and may be liable for damages equivalent to two months of the Model's Monetisation earnings.
• 13. TERMINATION OF WEBSITE ACCESS
  • 13.1. The Company reserves the right to immediately terminate the User's access to the Website at any time and without prior warning, penalty, or obligation to the User or any third party in the event that the User violates the Agreement, requirements of the law or takes any other actions that may result in a violation of the Agreement, requirements of the law.
  • 13.2. This remedy shall be used in addition to, and not in lieu of, any other rights or remedies that the Company may have in the event that the User violates this Agreement. The following sections will still be in force in the event that this Agreement is terminated for any reason: intellectual property, confidentiality, liability limitation, applicable law, and dispute resolution.
• 14. INDEMNIFICATION
  • 14.1. You agree to defend, indemnify, and hold Us harmless, including our subsidiaries, affiliates, and all of Our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of:
    • use of the Services;
    • breach of these Agreement, Privacy Policy, Cookie Policy;
    • any breach of Your representations and warranties set forth in this Agreement;
    • Your violation of the rights of a third party, including but not limited to intellectual property rights;
    • any violation of the law relating to the Services;
    • any overt harmful act toward any other User of the Services with whom You connected via the Services.
  • 14.2. You are liable to and will indemnify Us because of performing the above actions. This means You will be responsible for any resulting loss or damage We suffer.
  • 14.3. If, in connection with a violation of the Terms of Use, the Privacy Policy, legal requirements and other violations arising from the behavior of the Fan or the Model, we receive a lawsuit or remission, the User who instigated the violation agrees to be responsible, participate in the resolution of all disputes and reimburse the Company for all costs in the process of resolving such disputes and litigation.
  • 14.4. Notwithstanding the foregoing, we reserve the right, at Your expense, to assume the exclusive defense and control of any matter for which You are required to indemnify us, and You agree to cooperate, at Your expense, with our defense of such claims. We will use reasonable efforts to notify You of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.
• 15. APPLICABLE LAWS AND DISPUTE RESOLUTION
  • 15.1. Any dispute must be settled by contacting Us to support@askfornudes.com; such disputes shall be resolved within 60 (sixty) calendar days by contacting them via email.
  • 15.2. In the event that a dispute cannot be settled within 60 days, any dispute arising out of the use of the Services as well as the receiving, storing, processing, using and disclosing of the User's Personal Data should be governed by the laws of Cyprus.
  • 15.3. Should any provision or covenant within this Agreement be deemed unenforceable or invalid by relevant legal authorities or court rulings, the unenforceability or invalidity will not affect the overall enforceability or validity of this Agreement.
  • 15.4. If You have a complaint about AskForNudes (including any complaint about the Content appearing on AskForNudes or a User's conduct and about the removed Content), please send it to support@askfornudes.com, along with Your nickname, full name, email address used for the registration on AskForNudes, and contact information, a description of Your complaint, and, if Your complaint is about Content, the URL of the Content in question.
  • 15.5. We will investigate Your complaint within a 7 (seven) business days that is reasonable to its nature. We will contact You if We need additional information or documents.
  • 15.6. If the Content's investigation for the violations is pending, the Content will be unavailable and will be removed within 24 (twenty four) hours if it is found to be illegal or non-consensual content. Appeals must be submitted within 7 business days of notification, and a resolution will be provided within an additional 7 business days.
  • 15.7. You agree that You will at Your own cost promptly provide to Us all reasonable assistance (including by providing Us with copies of any information which We request) in Our investigation. We will not be responsible for any loss suffered by You arising from the suspension of access to Your Content or any other steps which We take in good faith to investigate any suspected non-compliance or unlawfulness of Your Content under this section.
  • 15.8. If We are satisfied that the Content is unlawful or non-consensual, We shall remove such Content during 24 (twenty-four) hours and notify You of Our decision via email.
  • 15.9. If We determine that the Content is not illegal or non-consensual, We will notify You via email.
  • 15.10. You can appeal the removal of the Content by sending Your complaint an email to support@askfornudes.com. We will investigate Your complaint within 7 (seven) working days, which is reasonable given its nature. If we determine that the Content does not violate the terms of the Agreement and/or applicable law, we will return it within 24 (twenty four) hours. If the Content breaches the terms of this Agreement and/or applicable legislation, we will send You within 24 (twenty four) hours the letter to the email address from where the complaint was submitted and will not restore the Content.
  • 15.11. If You are the User of AskForNudes, You warrant (which means You make a legally enforceable promise) that You will not make any complaint under this Agreement which is unjustified, abusive, or made in bad faith. If We determine that You have breached this warranty, We may terminate Your User account.
  • 15.12. We can disclose any information or records in Our possession or control about Your use of AskForNudes to law enforcement agencies in connection with any law enforcement investigation of any suspected or alleged illegal activity, to protect Our rights or legal interests, or in response to legal process.
• 16. CHANGES TO THE SERVICES AND WEBSITE
  • 16.1. The Website (or any part of it or related material) may be changed, suspended, or discontinued by the Company at any time and for any reason without prior notice, in its sole discretion. Before using the Website, the User can be asked to agree to a new Agreement (referred to as the "Revised Terms") at any time, at the Company's sole discretion, for any reason, and without incurring any obligations to other Users or parties. At some point, the Company may, at its sole discretion, limit access to the Website in order to perform maintenance and upgrades. The Company is not liable to any third party or the User for any modification, suspension, or termination of the Website or its content.
  • 16.2. Should the Agreement change, in order for the User to view certain web pages, access certain areas of the Website, or use certain functionalities, the User must accept the Revised Agreement. Users understand that it is their responsibility to stay informed about updates to the Website. While the Company makes every effort to notify Users of any updates to the Agreement, it is the Users' responsibility to independently check the Agreement each time they access the Website. Any modifications to this Agreement shall be complied with by Users immediately upon their publication.
  • 16.3. The Company disclaims all liability for communication issues resulting from the malfunction of third-party data centers' servers, routers, networks, etc., or from the User's choice of Internet provider that blocks access to the Website.
