Models' Terms of Use

You are currently visiting askfornudes.com or app.askfornudes.com which are operated by NINETAILS MEDIA LTD, a company duly registered under the laws of Cyprus, with principal office at Agias Faneromenis, 143-145, Patsias Court, Flat/Office 201, 6031, Larnaca, Cyprus ("AskForNudes", "Company", "We", "Us", "Our"). The interactions between Models and AskForNudes should be governed by the Terms of Service and these Models' Terms of Use, which herein collectively may be referred to as "Agreement".

Before using the Website, please carefully read this Agreement. If there is anything in this Agreement that You disagree with, please stop using the Website.

To understand how We process Personal Data, please refer to Our Privacy Policy. The Privacy Policy is an integral part of this Agreement and must be read in conjunction with them and before accessing the Company's Services.

These Models' Terms of Use are concluded in accordance with the laws of Cyprus.

• 1. THE SUBJECT MATTER AND DEFINITIONS
  • 1.1. The AskforNudes Terms of Services consist of the Terms of Services and Models' Terms of Use. By using AskForNudes as a Model, You agree to these Models' Terms of Use, which You should read carefully.
  • 1.2. By registering the Model account and accepting the terms of the Agreement, You entitle and give Us Your written Consent to publicly upload Your Content on Our Website.
  • 1.3. Only individuals can be the Models. The Agreement imposes direct obligations on every Model. If You have an agent, agency, management company, or other third party who assists You in managing Your Model account (or controls it on Your behalf), this has no influence on Your personal legal obligation. Our relationship is with You, not with any third party, and You will be legally responsible for ensuring that all Content posted, and Personal account activity is in accordance with the Agreement.
  • 1.4. In these Models' Terms of Use, defined terms have the same meanings given to them in the Terms of Services.
  • 1.5. Paywall Services refer to the Company's provision of technology allowing the Models to restrict access to their Content, requiring the Fans to pay a fee to unlock such access. The technology is developed and owned by the Company and the Model entitles the Company to set such Paywalls with the fee decided by the Model. The Paywall is set automatically, the Company is not obliged to check any Content, unless it has sufficient ground to suspice violations. The Company does not control or endorse the Content provided by the Models.
• 2. REGISTRATION AND USAGE OF THE WEBSITE FOR MODELS
  • 2.1. By registering on askfornudes.com or app.askfornudes.com, You accept our Agreement (Terms of Service, Models' Terms of Use, Privacy Policy, and Cookies Policy and any other agreements referred in these documents).
  • 2.2. The Model fills in the Registration Form on the Website by entering the relevant registration information, which includes nickname, password, email address, country of residence (eligible countries).
  • 2.3. To register the Model account, You need to add a high-quality photo in Your Personal account of a valid identity document that includes information about the person's age (passport, driver's license or ID card). Such a document confirms that the Model has reached the age of majority and provides the opportunity to use the Services. You also need to add a high-quality selfie with such the valid identity document and agree with Terms of Services, Privacy Policy and confirm the age of majority.
  • 2.4. After the registration on the Website and uploading all the documents, the Model's account will be at the verification stage. The Model will receive the letter on a registered email containing a verification link, which the Model needs to open and click on the word "link".
  • 2.5. After that, the Platform will need to review the provided identification documents. If the information provided during account registration is confirmed by the Company, a letter will be sent to the Model's e-mail address about the opening of the account and the Model will be able to use the Model account.
  • 2.6. If the Model has not provided a valid document confirming the identity and the age, or if We have found that the Model has not reached the age of majority, You will be denied account registration.
  • 2.7. In order to request withdrawals from the Model's account:
  • 2.7.1. You need to provide Us with the IBAN as well as Your first and last name;
  • 2.7.2. You need to fill in all the fields on the "Billing info" page;
  • 2.7.3. Depending on Your country of residence, You may be required to submit additional information;
  • 2.8. We may request further age or identity verification information at any time.
  • 2.9. You will then be able to begin uploading Content, communicate with Fans, and receive Fan Payment for such a Content.
• 3. MODEL'S CONTENT
  • 3.1. Models must comply with all rules, obligations, and restrictions outlined in Sections 4-6 of the General Terms of Service. The following additional obligations apply specifically to the Models.
  • 3.2. We are entitled to set the Paywall for the Fans in order to access and view Your Content on AskForNudes for their own lawful and personal use.
  • 3.3. You warrant that for each item of Content that You post, display, upload, or publish on AskForNudes:
  • 3.3.1. The Content must comply with the Terms of Service, and You have all required rights to license it to AskForNudes in all territories where You have Fans.
  • 3.3.2. You either own Your Content (including all intellectual property rights) or have a legitimate license to offer and supply Your Content to Fans.
  • 3.3.3. If Your Content includes or uses any third-party material, You have secured all rights, licenses, written consents, and releases that are necessary for the use of such third-party property in Your Content as well as the subsequent use and exploitation of that Content.
  • 3.3.4. Your Content does not include the presence of other people, unless authorized. If any other individual except You is depicted in the Content, You must not blur them, but rather remove the Content from the chat.
  • 3.3.5. BLURRING people in the background is NOT allowed.
  • 3.3.6. The Content is of satisfactory quality, taking into account any description of the Content, the price, and all other relevant circumstances, including any statement or representation You make about the nature of the Content on Your account or in any advertising; reasonably suitable for any purpose that the Fan has made known to You; and as described by You.
  • 3.3.7. Models using prohibited AI-generated Content agree to indemnify us and hold harmless from any claims, damages, or legal costs arising from the use of such Content.
  • 3.4. In order to prevent distribution of any Content that violates our Terms of Service, We may, but are not obliged, monitor the uploaded Content and remove if any appears to violate our Terms. The Models assume full responsibility for ensuring their Content complies with all applicable laws and the Agreement.
  • 3.5. If a User has been accidentally depicted in the Content, they have the right to appeal the placement of such Content on the Website, and after considering the appeal, if the Model fails to evidence the legitimacy of such Content within 3 days, AskForNudes will remove such a Content.
  • 3.6. The Model's Content can be provided by the Model for free or on a paid basis by requesting Us to set the Paywall on it. The Model independently sets the Paywall's price for the relevant Model's Content.
  • 3.7. Upon termination of Your account, We may deal with Your Content in any appropriate manner in accordance with our Privacy Policy (including by deleting it) and You will no longer be entitled to access Your Content. There is no technical facility on AskForNudes for You to be able to access Your Content following termination of Your account.
  • 3.8. We are not responsible for or support any portion of the Content provided by You or any other AskForNudes User. We are under no obligation to monitor any Content and have no direct control over what Your Content may include.
  • 3.9. It is strictly prohibited to advertise any goods or services in the Content and include them in Your account, particularly alcoholic beverages, tobacco products, and products that promote violence or prejudice.
  • 3.10. The User acknowledges, understands, and agrees that the Company is the sole owner of all intellectual property rights to AskForNudes and Services. The Agreement prohibits the unauthorized use of any trademarks.
• 4. FEES AND MONETISATION PROGRAM TERMS
  • 4.1. Joining the Agreement, the Model is allowing us to set the Paywall on each unit of his/her Content. In order to unblock such the Content, the Fan has to pay the appropriate price, which is set by the Model.
  • 4.2. For each unit of Your Content unlocked by the Fan, You are entitled to monetise 80% (eighty percent), minus any taxes, of services for removing Paywall ("Monetisation").
  • 4.3. Our Fee comprises Paywall Services, payment system fees, the costs of supplying, maintaining, and running AskForNudes, as well as the storage of Your Content. Our Fee is deducted from the Fan Payment, and Monetisation earnings are distributed to You in the manner outlined in the section below.
  • 4.4. Payment information will be received by the Model via the "Wallet" page of the Model's account where the Model will be able to view the amount of funds received through Monetisation program. To withdraw such funds, the Model needs to create a request, choosing the withdrawal method and entering bank details (IBAN and full name). Your Monetisation earnings will be updated in Your account within a reasonable time frame. Which will be available for withdrawal from Your account whenever such Monetisation earnings emerge. The estimated time for the processing of the withdrawal in order to send the Monetisation earnings to the Model's bank account shall be at least 16 calendar days.
  • 4.4.1. The Company reserves the right to delay withdrawal requests for any enhanced compliance checks, including but not limited to legal investigations or suspected breaches of this Agreement. You waive your right to any late payment claims, as We, in our sole discretion, decides when such payments are due. In any way, We will not unreasonably delay with such payments, unless necessary for our compliance.
  • 4.5. Pending balance. Before the withdrawal of the Monetisation earnings, the recent Fans' payments of the Model shall be withheld for 8 calendar days after the payment date on the Pending balance of such Model's account which can be seen on the "Wallet" page. The Company reserves the right to use this funds during the pending time if the refund is requested by the particular Fan properly and according to the Terms of Service, the Models' Terms of Use and Our Refund Policy.
  • 4.6. To initiate a withdrawal, You must meet the minimum balance requirement. The minimum amount for withdrawal is displayed on the "Wallet" page of Your account.
  • 4.7. The amount displayed in Your current balance in Your account represents Your Monetisation earnings. All Fan Payments and Monetisation earnings are processed in USD only. If You select Our payment processor, the Fan Payments and Monetisation earnings information will be displayed in Your local currency at an exchange rate set by Our payment processor. Your bank may charge You for currency conversion or transfer fees when You get the money. Additionally, Your e-wallet provider may charge You a fee for accessing the funds. We have no control over currency conversion rates or charges imposed by Your bank or e-wallet provider, and We will not be liable for any charges imposed by Your bank or Your e-wallet provider.
  • 4.8. We make no representations or warranties, expressed or implied, that You will receive any payment if Your Content is monetized but it was discovered that you have violated this Agreement or applicable laws.
  • 4.9. By using the platform as the Model, You warrant that You have reported, and will continue to report, all payments made to You in connection with Your use of the website to the relevant tax authorities, as required by law.
  • 4.10. All Fan Payments will be processed by a third-party payment provider accepted by Us. Our Fee will be deducted from the Fan Payment, and We will hold Your Monetisation earnings on Your behalf.
  • 4.11. Breach. You agree to indemnify Us for any failure to comply with Your obligations under this Agreement. This means You will be responsible for any loss or damage (including loss of profit) we suffer due to Your non-compliance, such as failing to deliver content after a Fan Transaction is confirmed or otherwise trying to circumvent Your obligations.
  • 4.12. We may withhold all or any portion of the Monetisation earnings owed to You but not yet paid out, 1) If we suspect unlawful or fraudulent activity by You or the Fan; 2) If we become aware that Your Monetisation earnings have been secured, encumbered, pledged, or assigned to a third party, or if any lien has been placed on them. We have no obligation to pay third-party lienholders and will withhold payment until the lien is resolved.
  • 4.13. If We are withholding all or any part of the Monetisation earnings owed to You, and We determine that a portion of the Monetisation earnings withheld is unrelated to breaches by You of the Agreement or suspected unlawful or fraudulent activity, We may arrange for You to be paid the portion of the Monetisation earnings that We determine to be unrelated to breaches by You of the Agreement or suspected unlawful or fraudulent activity. However, You agree that if We believe that Your breach(es) of the Agreement has or may cause Us loss, We may withhold all the Monetisation earnings due to You but not yet paid and set against such amounts against any losses sustained.
  • 4.14. If, after conducting Our review, We conclude that the Monetisation earnings are forfeited, We shall use Our best efforts (unless prohibited by law) to ensure that any Fan Payments that resulted in forfeited the Monetisation earnings are refunded to the relevant Fans who made the Fan Payment.
  • 4.15. If we suspect fraudulent or unlawful activity by You or a Fan, we may examine Your Monetisation earnings and transactions for as long as necessary. This investigation could result in withholding or forfeiture of Your earnings if a violation is confirmed.
  • 4.16. Payment Hold. If a Model chooses to delete the Model account, the Company will hold the Model's last payment for 6 (six) months from the date of account closure.
  • 4.16.1. This is due to the fact that in the event of violations of the Agreement or legal requirements, the Company will be able to return Fan's funds.
  • 4.16.2. After the passage of 6 (six) months and in the absence of any complaints, violations of the requirements of the law and this Agreement, the Model's funds will be transferred to her account.
  • 4.16.3. f a Fan successfully requests a refund or chargeback from their credit card provider in relation to a Fan Payment made, We may investigate and elect to withdraw from Your account an amount equivalent to the Monetisation earnings generated by You on the charged-back or refunded amount.
  • 4.17. The Models cannot delete their personal Models’ account if :
    • 4.17.1. any amount of funds is available on their Pending balance;
    • 4.17.2. any amount of funds is available for withdrawal or there is any active withdrawal request still unprocessed by Us;
    • 4.17.3. the Model's account is under investigation process started by AskForNudes because of the violation of the Website's Terms of Service and/or Models' Terms of Use;
    • 4.17.4. there are any unprocessed refunds' requests that are related to their Model's account;
    • 4.17.5. there is any other legitimate reason that prevents the ordinary process of deleting their Model's account.
  • 4.18. The Model is able to delete the Content that has already been unlocked by the Fan only through a separate request by sending an email to support@askfornudes.com.
  • 4.19. The Company is not responsible for ensuring the Model's compliance with any tax reporting or payment obligations related to Monetisation earnings.
• 5. INTELLECTUAL PROPERTY
  • 5.1. You certify that You control all intellectual property rights (such as copyright and trademarks) in Your Content, or that You have obtained all necessary rights to Your Content in order to provide licenses to Us and other Users. This includes any rights required to engage in the acts described in the Agreement in any region where AskForNudes is available.
  • 5.2. You agree to grant Us a license under all of Your Content to perform any act limited by any intellectual property right (including copyright) in the such Content for any purpose reasonably linked to AskForNudes' distribution and operation. Such acts include hosting, setting Paywall, reproducing, making available, displaying Your Content, as well as otherwise dealing with it.
  • 5.3. The Model as an owner of intellectual property rights for the Content allow Us the limited right to send notices of infringement (including copyright or trademark) on Your behalf to any third-party Website or service that hosts or otherwise deals with infringing versions of Your Content without Your consent. Although We are not obligated to do so, We may at any time submit or withdraw any such notification to any third-party Website or service that We deem suitable. However, We have no obligation to investigate infringements of Your Content.
  • 5.4. You agree that if We ask, You will provide Us with all consents and other information that We reasonably require filing infringement notifications on Your behalf. Please refer to the Section 12 of Our Agreement for information on how to file a complaint regarding intellectual property violation.
  • 5.5. You waive any moral rights You may have under applicable law to object to negative treatment of any Content that You submit on AskForNudes. This waiver has no bearing on Your ownership of any intellectual property rights in Your Content, nor does it impact Your rights to prevent Your Content from being duplicated without permission. The waiver allows Us to add watermarks, stickers, or text on Your Content (as permitted by the license granted to Us in the Agreement).
  • 5.6. Users may instantly lose access to the Website and be held legally responsible in line with the applicable laws if they violate the Agreement. Regarding the Content posted on the Website, the Company is the exclusive owner of all rights.
  • 5.7. Company's intellectual property rights. The company retains all its exclusive intellectual property rights in the Website, platform, technologies and any services provided under the Agreement. This does not impact the intellectual property of Models over their Content, except for the limited licenses granted under this Section 5.
• 6. WARRANTIES AND WAIVERS
  • 6.1. Models warrant that:
    • 6.1.1. they are of legal age in their country, which is not less than 18 years old to be eligible to become the Model;
    • 6.1.2. they have read the Model's Terms of Use, Terms of Service, Privacy Policy and Cookie Policy on the Website very carefully;
    • 6.1.3. they own the Content, and it is not prohibited under the Terms of Service;
    • 6.1.4. the Monetisation terms are not prohibited in the jurisdiction of their location;
    • 6.1.5. they will report and comply with tax obligations for any income earned through the platform, as required by the jurisdiction of their location;
    • 6.1.6. they will not represent themselves as associates with the Company.
    • 6.1.7. they will not hamper the Company's monitoring services, if any, to check the Content for compliance with these Model's Terms of Use.
  • 6.2. You agree that You will be accountable to Us and indemnify Us if any of the warranties in the Agreement are false. This means You will be liable for any loss or damage (including loss of profit) incurred as a result of the promises being untrue.
  • 6.3. Models waive their right to hold the Company liable for any losses related to technical issues.
• 7. INTEGRAL PART
  • 7.1. These Models' Terms of Services are additional terms which apply if You use AskForNudes as the Model. These Models' Terms of Use form an integral part of Your Agreement with Us.
  • 7.2. Sections that contain in the Terms of Service, in particular: RULES OF USAGE, PROHIBITED CONTENT, INTELLECTUAL PROPERTY AND PROPRIETARY RIGHTS, LINKS TO OTHER WEBSITES, DISCLAIMERS AND LIMITATION OF LIABILITY, TERMINATION OF WEBSITE ACCESS, INDEMNIFICATION, APPLICABLE LAWS AND DISPUTE RESOLUTION, CHANGES TO THE SERVICES AND WEBSITE are fully applicable to the Models' Terms of Use.
